    Purpose of this Privacy Policy

    This Privacy Policy has been compiled to provide information regarding how JAYKAY Mobility (Zambia) Pte. Ltd.("JAYKAY"), its JAYKAY ride hailing service(" Service"), its related entities, affiliates and subsidiaries (individually and collectively referred to herein as" JAYKAY"," us"," we" or"our") collects, uses, stores, processes, discloses and/or transfers (collectively," handles") Personal Data (as defined below) collected by JAYKAY, whether through JAYKAY'S App(s) (as defined below), JAYKAY's Website(s) (as defined below) or any other means, and is a component of our Terms and Conditions.

    This Privacy Policy applies to the Personal Data of individuals, being (i) drivers using JAYKAY's mobile application (such "Driver") (collectively referred to as "you" or "your"), that has been provided to us in connection with our relationship with you and/or the use of any mobile application owned, maintained or created by JAYKAY or its affiliates (such "JAYKAY App(s)") or any website owned, maintained or created by JAYKAY or its affiliates (such "JAYKAY Website(s)").

    By providing your Personal Data, you hereby agree and consent to JAYKAY handling your Personal Data in the manner set forth in the prevailing Privacy Policy which may be updated or modified from time to time.

    This Privacy Policy does not affect any rights which JAYKAY may have at law in connection with the handling of your Personal Data. JAYKAY may from time to time update this Privacy Policy. You agree to be bound by the prevailing terms of the Privacy Policy as updated from time to time on JAYKAY Website(s).

    Collection of Personal Data

    1.1 General Terms

    "Personal Data" refers to information that identifies you, including but not limited to: your name, nationality, residential address, city, NRC number, telephone number, bank details, credit card details, gender, email address, occupation, photo, and location data (including current and past locations), along with any other data you voluntarily provide through registration forms, application forms, or other similar forms used within JayKay Ride and JayKay Pro apps.

    1.2 Purpose of Data Collection

    The data we collect serves the following purposes:

    • User Registration: To enable the creation of a user profile in the app and provide core app functionalities (e.g., ride requests, driver services).
    • Location Data: Your location data is collected to:
      • Provide real-time ride tracking.
      • Ensure accurate driver-rider matching.
      • Facilitate route navigation and ETA calculation.
      • Enable ride requests and pickups.
      • Improve the overall user experience by allowing us to provide better services.

      NOTE: Location can be accessed in the background for same purposes listed above.

    • Transaction Data: To process payments, monitor ride history, and resolve any issues.
    • Safety and Security: To enhance the safety of riders and drivers, ensuring proper communication and accountability between both parties.
    • Verification Information: For identity and driver verification purposes (e.g., NRC number, nationality, residential address).

    1.3 Specific Data Collected from Drivers

    If you are a driver, we may collect additional telematics data, including but not limited to accelerometer, GPS data, braking patterns, and other data collected when your driver-specific app is active. This data is crucial to improving service delivery and maintaining the safety and quality of rides.

    1.4 Use of In-Vehicle Cameras

    If any drivers use personal in-vehicle cameras, such data collection is not managed by JayKay. Drivers are solely responsible for obtaining consent from passengers. JayKay does not store or use any in-vehicle camera data, and any such data is outside the scope of JayKay's services.

    1.5 Third-Party Data Collection

    JayKay may also collect personal data from publicly available sources, third-party service providers, or through interactions with third-party systems, such as:

    • Social media platforms (if you follow, like, or interact with JayKay pages).
    • Credit reporting agencies and insurance providers (for driver verification).
    • Marketing services or partners.

    1.6 Legal Binding

    By using the JayKay Ride and JayKay Pro apps, you consent to the collection, storage, and use of your personal data as outlined in this privacy policy. You understand that certain data is required for the proper functioning of the app and services. You also acknowledge that JayKay may share your data as required by law or for compliance with regulatory requirements.

    If you do not provide the required data, JayKay may be unable to provide the services as described in the app.

    3.1 Retention of Data

    Your personal data will be retained as long as necessary to fulfill the purposes outlined in this policy unless a longer retention period is required or permitted by law.

    Disclosure and/or transfer to third parties

    JAYKAY does not sell, trade, or otherwise transfer to outside parties your Personal Data without your consent. Subject to the provisions of any applicable law, certain Personal Data may be disclosed and/or transferred for the purposes listed in sections 3 and 4 (where applicable) to the following third parties, whether they are located in Zambia or overseas:

    1. the respective User and Driver in relation to the matched ride-hailing service provided on the JAYKAY App, only to the extent that the Personal Data is necessary for completing the ride-hailing service;
    2. JAYKAY's affiliates;
    3. vendors or any third-party business partners who offer goods and services or other promotional programmes on the JAYKAY App(s) or JAYKAY Website(s), whether in conjunction with us or not;
    4. our professional advisors such as our auditors and lawyers;
    5. relevant governmental, regulatory, supervisory or judicial or other equivalent bodies or authorities or law enforcement agencies;
    6. any third parties to whom we are required by or requested to or, under any obligation to disclose and/or transfer Personal Data pursuant to law or regulation or any legal process;
    7. any other party to whom you authorise us to disclose and/or transfer your Personal Data;
    8. any other third party within or outside of Zambia, or to another entity within our stable of companies that may include overseas entities or to another entity that is a prospective acquirer or successor to all or part of JAYKAY's businesses.

    Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
